| Summary | Today's topic was the Issur of Lo Sachmoid. There are 3 levels to this: a) Kin'oh b) Lo Sisaveh c) Lo Sachmoid. Question: If my friend has a skill and I manipulate him until he shares his professional knowledge with me, would this fall under the parameters of Lo Sachmoid? According to the Aruch Hashulchan, the issur applies only to tangible objects, where a Kinyan would be relevant. An extremely interesting Macholikes between the Rambam and Ra'avad followed, with regard to the issue of whether Lo Sachmoid is considered a "Lav She'ein bo Ma'aseh" with logic provided behind each opinion. An interesting Steipler was thrown in to the mix to help explain the above. Several other fascinating scenarios followed; what if a Father left an inheritance, but one of the sons is not too impressed with what was left for him and he attempts to get one of his siblings to relinquish his portion? What about if you ask someone for their object and they readily agree to give up the object immediately - with no further persuasion necessary? The Chofetz Chaim also discusses a case of a Chosson who decides he is rather unimpressed with the dowry promised to him by his future Father-in-Law and tries to negotiate a "better deal"...! All this and much more... |
